Terms of Service

1. Acceptance of Terms

By scheduling, purchasing, or receiving pest control services from The Bugs Stop Here ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all residential and commercial pest control services provided by The Bugs Stop Here throughout our service areas in New York State.

2. Services Provided

The Bugs Stop Here provides professional pest control, pest management, and pest prevention services including but not limited to treatment for ants, termites, bed bugs, cockroaches, rodents, mosquitoes, ticks, wasps, spiders, wildlife, and other common household and commercial pests. Services are performed by licensed and insured pest control technicians in accordance with New York State Department of Environmental Conservation (DEC) regulations.

The specific scope of each service engagement will be determined during the initial inspection or consultation and confirmed prior to treatment. All treatments are performed using EPA-registered products applied according to label instructions and applicable state and federal regulations.

3. Scheduling and Cancellations

3.1 Appointments

Service appointments are scheduled based on mutual availability. We make every effort to accommodate your preferred date and time, including same-day and next-day service when available. Appointment times are approximate and may vary based on prior service calls, travel, and weather conditions.

3.2 Cancellation Policy

We require at least 48 hours' notice for appointment cancellations or rescheduling. Cancellations made with less than 48 hours' notice may be subject to a cancellation fee of up to $75. Repeated no-shows or late cancellations may result in a requirement for prepayment before future service appointments are confirmed.

3.3 Access to Property

You agree to provide our technicians with reasonable access to the property at the scheduled appointment time. If our technician arrives and cannot access the property or the areas requiring treatment, the visit may count as a completed service call and applicable fees may apply.

4. Payment Terms

4.1 Pricing

Service pricing is provided in advance as part of your free inspection and estimate. The quoted price is valid for 30 days from the date of the estimate unless otherwise stated. Pricing is based on the scope of work identified during the inspection — if conditions differ from what was originally assessed, revised pricing may be provided before additional work begins.

4.2 Payment

Payment is due upon completion of service unless otherwise arranged in a service agreement or maintenance plan. We accept major credit cards, debit cards, and checks. For ongoing service plans, payment will be charged according to the billing schedule outlined in your service agreement.

4.3 Late Payment

Invoices not paid within 30 days of the service date may be subject to a late fee of 1.5% per month on the outstanding balance. We reserve the right to suspend future services for accounts with outstanding balances.

5. Service Guarantee and Limitations

5.1 Guarantee

We stand behind our work. If covered pests return between scheduled treatments, we will re-treat the affected areas at no additional charge, subject to the terms of your specific service agreement. Guarantees apply only to the pests and areas specified in your service agreement and are contingent on the Customer meeting preparation requirements outlined in Section 7.

5.2 Limitations

Pest control treatments reduce and manage pest populations but cannot guarantee the complete elimination of all pests in all circumstances. Results depend on factors including property conditions, sanitation, neighboring properties, structural integrity, and environmental factors beyond our control. Our guarantee does not cover re-infestations caused by new pest introductions unrelated to the original treatment.

6. Liability Limitations

The Bugs Stop Here carries general liability insurance and workers' compensation insurance as required by New York State law. Our liability for any claim arising from services provided is limited to the amount paid for the specific service in question.

The Bugs Stop Here shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to property damage not directly caused by our technicians, loss of use, loss of income, or damage resulting from pre-existing structural conditions. We are not responsible for damage caused by pests prior to or after our treatment, nor for conditions that make a property susceptible to pest activity (such as moisture intrusion, structural gaps, or sanitation issues).

You agree to notify us in writing within 7 days of any property damage you believe was caused by our service. We will promptly investigate any such claims.

7. Pest Control Preparation Requirements

Certain treatments require preparation by the Customer prior to the service appointment. Our technician or office staff will provide specific preparation instructions before your appointment. Common preparation requirements may include:

  • Clearing areas around baseboards, under sinks, and behind appliances
  • Removing pets, pet food, and water dishes from treatment areas
  • Covering or removing fish tanks and aquariums
  • Laundering and bagging bedding and linens (for bed bug treatments)
  • Vacating the premises for a specified period during and after treatment

Failure to adequately prepare the property for treatment may reduce treatment effectiveness and may void service guarantees for that visit. If our technician determines that inadequate preparation prevents safe or effective treatment, the service may be rescheduled and applicable fees may apply.

8. Privacy and Data Use

We collect and use personal information solely for the purpose of providing pest control services, communicating about appointments and service plans, and improving our services. Information collected may include your name, address, phone number, email address, and property details relevant to pest management.

9. Communications Consent (TCPA)

By providing your phone number to The Bugs Stop Here, you consent to receive calls and text messages from us, including via automated dialing systems and prerecorded messages, for purposes related to your pest control service including appointment confirmations, reminders, follow-ups, and service-related communications. Message and data rates may apply. Message frequency varies.

You may opt out of text messages at any time by replying STOP to any message. You may opt out of marketing calls by contacting us at (631) 563-3900. Opting out of marketing communications will not affect service-related communications necessary to fulfill your service agreement.

Consent to receive communications is not a condition of purchasing services from The Bugs Stop Here.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising from or related to these terms or services provided by The Bugs Stop Here shall be resolved in the courts of the State of New York. You agree to submit to the personal jurisdiction of the courts located in the State of New York for the purpose of litigating any such disputes.

11. Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
